The #LivePD2019Sweepstakes Official Rules
1. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID ANYWHERE OUTSIDE OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA, AND WHEREVER PROHIBITED OR RESTRICTED BY LAW.
2. Eligibility/Participation: The #LivePD2019Sweepstakes (the “Sweepstakes”) is open to legal residents of the fifty (50) United States (including the District of Columbia), who are at least eighteen (18) years of age, or the age of majority in their jurisdiction of residence, whichever is greater, at the time of Entry (defined below). Employees, their immediate families (i.e., parents, spouse, children, siblings, grandparents, step parents, step children and step siblings) of A&E Television Networks, LLC (“Sponsor”), and Advantage Sales & Marketing LLC, d/b/a The Sunflower Group (“Administrator”), and their respective affiliated companies, sponsors, subsidiaries, advertising agencies and third party fulfillment agencies (collectively, with Sponsor, the “Sweepstakes Entities”) are not eligible to enter the Sweepstakes. By participating in this Sweepstakes, Entrants (defined below) agree to: (a) be bound by these Official Rules and by the interpretations of these Official Rules by Sponsor, and by the decisions of Sponsor, which are final in all matters relating to the Sweepstakes; (b) release and hold harmless each of the Sweepstakes Entities and their respective agents, employees, officers, directors, successors and assigns, against any and all claims, injury or damage arising out of or relating to participation in this Sweepstakes and/or the use or misuse or redemption of a Prize, and for any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property related cause of action.
3. Sweepstakes Period: The Sweepstakes commences at 8:00 PM Eastern Time (“ET”) on January 3, 2019, and ends at 10:00 PM ET on January 3, 2019 (the “Sweepstakes Period”).
4. How To Enter: During the Sweepstakes Period, you may earn one (1) Entry (defined below) into the Sweepstakes by (i) posting a tweet to your Twitter feed, including the hashtag #LivePD2019Sweepstakes and (ii) follow Live PD on A&E® (@officiallivepd) on Twitter through the Sweepstakes Period and for at least thirty (30) days thereafter.
In order to enter the Sweepstakes, you must have internet access and be a registered member of Twitter with a non-private account in good standing. To become a registered member of Twitter (registration is free), go to www.twitter.com and follow the instructions to create an account. Entries must be received by 10:00 PM ET on January 3, 2019 to be eligible for the Sweepstakes. Use of computer programs or other automatic means to enter the Sweepstakes is prohibited. Use of any automated system to participate is prohibited and will result in disqualification. Normal Internet/phone access and data/usage charges imposed by your online/phone service may apply. The Sponsor's database clock will be the official timekeeping device of the Sweepstakes. All properly completed Entries will automatically be entered into the Sweepstakes. Entries must include the hashtag in order to be eligible. Entry must comply with Twitter’s Terms of Service, which Entrants can access at https://twitter.com/en/tos. In the event of any dispute concerning the identity of any Entrant, the relevant Entry will be deemed submitted by the authorized account holder of the respective Twitter account used to enter. Entrants understand that they are providing their information to Sponsor. To participate in this Sweepstakes, each Entrant will be subject to the Sponsor's Terms of Use and Privacy Policy. Please read these policies before entering the Sweepstakes.
Each Entrant hereby grants and agrees to grant to Sponsor and to each of the other Sweepstakes Entities the right to exhibit, webcast, podcast, broadcast, copy, reproduce, encode, compress, encrypt, incorporate data into, edit, rebroadcast, transmit, record, publicly perform, display, create derivative works of, distribute and synchronize in time related to visual elements, post, and/or otherwise use and/or exploit their Entry or any parts thereof, in perpetuity, throughout the universe, in any manner or media now existing or hereinafter devised, including, but not limited to, the right to make any and all uses thereof (including for purposes of advertising or trade) without any compensation to Entrant.
Entrants agree that their Entry shall not contain, include or involve any of the following:
• Obscene, crude, vulgar or offensive pictures, depictions, images, language and/or symbols
• Gang signs or symbols, or any form of threat or violence towards others
• Sexual activity or nudity
• Illegal drug or alcohol use
• Commercial products (e.g., clothing, toys, food) and/or their trademarks, brands, logos or endorsements
• Unauthorized trademarks and copyrighted material (e.g., music, etc.)
• Any personally identifying information (e.g., license plates, phone numbers, physical and/or email addresses)
• Website or web page links
• Derogatory characterizations of any ethnic, racial, sexual or religious groups, humiliation of other people (publicly or otherwise)
• Trespass or the violation of other people’s rights or property
• Illegal (e.g., discriminatory, harassing) or inappropriate activity, behavior or conduct (e.g., inflicting emotional distress)
• Conduct or activities in violation of these Official Rules
Any other content, display, materials and/or images that is or could be considered inappropriate, unsuitable or offensive, as determined by Sponsor in its sole discretionThe Sweepstakes Entities are not obligated to, use, publish, display or broadcast any Entry. Each Entrant acknowledges that the Sponsor will rely on such Entrant’s agreement and compliance with these Official Rules when Entrant submits or attempts to submit the Entry. The Sponsor reserves the right to reject any Entries that it deems, in its sole discretion, to violate any of their policies or the terms and conditions set forth in these Official Rules.
5. Prize Random Drawing: On or about one (1) business day after the end of the Sweepstakes Period, Administrator will perform one (1) Prize random drawing (the “Prize Drawing”), from among all eligible Entries received throughout the entire Sweepstakes Period, in order to select fifty (50) potential Prize winners. The odds of being selected as a potential Prize winner will depend upon the total number of eligible Entries received throughout the Sweepstakes Period.
6. Prizes: Fifty (50) winners (each, a “Prize Winner” and, collectively, “Prize Winners”) will each receive one (1) sponsor-specified K9 pillow. Total approximate retail value (“ARV”) of each prize is Thirty Six Dollars and Twenty Five Cents ($36.25). The total ARV of all prizes is One Thousand Eight Hundred and Twelve Dollars and Fifty Cents ($1,812.50). Additional prize restrictions, limitations and exclusions may apply.
7. Prize Winner Notification/Verification: On or about one (1) business day after the Prize Drawing, Administrator will notify each potential Prize winner via a Direct Message to their Twitter account. The potential Prize winners may then need to verify their mailing address/eligibility via email within seven days (7) days of notification attempt or the prize may be forfeited and an alternate winner may be selected. If in any instance, notification attempt(s) for a potential Prize winner fail for any reason, if a potential Prize winner does not respond in the time provided, if an email sent to a potential Prize winner is returned as undeliverable, or if a potential Prize winner is found to have not complied with these Official Rules, the applicable Prize will be forfeited and an alternate winner will be selected from among remaining eligible Entries, if any. By entering, all Entrants and the potential/confirmed Prize winners hereby consent to the use by the Sweepstakes Entities of their Entry and all information contained therein including but not limited to: name, likeness, opinions, images, statements and/or other indicia of persona, and personally identifiable information (collectively “Likeness”), for any and all uses and purposes in any media now known or hereinafter developed throughout the world (including the World Wide Web and on-air) without additional consideration (where legal), consent or prior review, and upon request will provide written consent to such use. Noncompliance, failure to return any documents within the time specified, failure to respond to notification attempts or returns of any Prize/Prize notification as undeliverable will result in disqualification and an alternate potential winner will be selected. Prize winners must also complete any additional legal documents provided by Sponsor (or third party on its behalf, if applicable) with respect to their Prize and return them as instructed within the timeframe specified by Sponsor or Prize winners may forfeit their Prize at Sponsor’s sole discretion. All decisions of Sponsor relating to the Sweepstakes are final.
8. General Terms: All Prize details are at Sponsor’s discretion. In no event will Sponsor be responsible for awarding more than number of Prizes detailed herein. No transfer or substitution will be permitted, except at Sponsor's sole discretion, due to Prize unavailability for any reason. Noncompliance with any of these Official Rules may result in disqualification. Sponsor assumes no responsibility for incorrect or inaccurate Entry information whether caused by any of the equipment or programming associated with or utilized in this Sweepstakes or by any human error, which may occur in the processing of the entries in this Sweepstakes. Sponsor is not responsible for any problems or technical malfunctions of any telephone network or lines, computer online systems, servers or other services, or providers, computer equipment, software, failure of any e-mail or players on account of technical problems or traffic congestion on the Internet or at any website, including Twitter, or any combination thereof, including, without limitation, any injury or damage to Entrant's or any other person's computer related to or resulting from participation or downloading any materials in this Sweepstakes. Sponsor is not responsible for any typographical or other error in administration of the Sweepstakes, or in the announcement of the Prize winners. If, for any reason, the Sweepstakes is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted on the Site or elsewhere as Sponsor sees fit, and the Prizes will be awarded via random drawing from among all eligible Entries received up until the time of cancellation or termination or in a manner that is fair and equitable as determined by Sponsor. All interpretations of these Official Rules and decisions by Sponsor are final. No software-generated, robotic, programmed, script, macro or other automated online or text message entries are permitted. Sponsor reserves the right in its sole discretion to disqualify any individual it suspects or finds: (i) to have used a software-generated, robotic, programmed, script, macro or other automated online Entry; (ii) to have tampered with the Entry process or the operation of this Sweepstakes; (iii) to be acting in violation of these Official Rules; (iv) to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; or (v) to have provided inaccurate information on any legal documents submitted in connection with this Sweepstakes. CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR APPLICATION OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. THE NEW YORK COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE SWEEPSTAKES AND THE LAWS OF THE STATE OF NEW YORK SHALL GOVERN THE SWEEPSTAKES. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THESE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS. ENTRANTS AGREES THAT ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS SWEEPSTAKES OR ANY PRIZE AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION AND IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEW YORK WITHOUT REGARD TO PRINCIPLES OF CONFICTS OF LAW.
9. Limitation of Liability: Entrants agree that the Sweepstakes Entities (a) shall not be responsible or liable for, and hereby release the Sweepstakes Entities from, any claims, losses, damages or injuries of any kind (including death) resulting, in whole or in part, directly or indirectly, from participation in the Sweepstakes or any Sweepstakes-related activity, or from acceptance, receipt, possession and/or use/misuse or inability to use a Prize, and (b) have not made any warranty, representation or guarantee, express or implied, in fact or in law, with respect to a Prize, including, without limitation, to such Prize’s quality or fitness for a particular purpose. Sponsor and the Sweepstakes Entities shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience or irregularity that may be caused or contributed to (1) by any wrongful, negligent or unauthorized act or omission on the part of any of their agents, servants, employees or independent contractors; (2) by any wrongful, negligent or unauthorized act or omission on the part of any other person or entity not an employee of the Sweepstakes Entities; or (3) by any other cause, condition or event whatsoever beyond the control of the Sweepstakes Entities. Failure of Sponsor to enforce any provision herein shall not be deemed a waiver of such. Sponsor reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the Sweepstakes. UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANTS HEREBY WAIVE ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR ANY OTHER DAMAGES WHATSOEVER. IN NO EVENT SHALL THE SWEEPSTAKES ENTITIES, COLLECTIVELY, BE LIABLE TO ANY ENTRANT OR WINNER FOR DAMAGES THAT EXCEED THE VALUE OF THE PRIZE TO BE AWARDED.
10. Request for the Names of Winners and/or Official Rules: For the names of the Prize winners, available after February 4, 2019, send a self-addressed stamped envelope, to be received by March 4, 2019, to: The #LivePD2019Sweepstakes Winner List, c/o Advantage Sales & Marketing LLC, d/b/a The Sunflower Group, 360 Lexington Ave, 19th Floor, New York, NY, 10017.
