OFFICIAL RULES
  1. ELIGIBILITY: NO PURCHASE IS NECESSARY TO ENTER OR WIN.  Void in Alaska, Hawaii, Puerto Rico and where prohibited by law. Open only to legal residents of the 48 contiguous United States and the District of Columbia who are 21 years of age or older with a valid U.S. driver’s license as of date of entry.  A&E Television Networks (“Sponsor”), Civic Entertainment Group, LLC (“Administrator”), Towbin Dodge, any companies associated with or responsible for the creation/distribution/production of “King of Cars,” and each of their respective parents, affiliates, subsidiaries, advertising and promotional agencies, prize providers, participating retail locations and each of their respective officers, directors, employees and members of the immediate family and persons living in the same household of each are ineligible. Employees of and independent sales personnel retained as independent contractors of professional car dealers are also ineligible.  Contest begins at 9:00 AM (ET) on February 28, 2006 and ends at 11:59 PM (ET) on March 21, 2006 ("Promotion Period").  The theme of the contest is to create a thirty (30) second video showing how you would sell a used car. No actual sale or attempted sale of a car is necessary.

  2. TO ENTER:  There is only one way to enter this contest.  Visit www.aetv.com between 9:00 AM (ET) on February 28, 2006 and 11:59 PM (ET) on March 21, 2006.  Click on the “Top Chop” contest link and follow the on-screen directions, entering all requested information on the entry form and then upload the file of your 30-second video (the “Video”).  You must complete the official entry form and check the box indicating that you have read, understand and agree to the Official Rules as well as the “Permission to use video” form (whereby, among other things, entrant irrevocably grants to A&E Television Networks all rights in and to the Video).  IF YOU DO NOT AGREE TO THESE OFFICIAL RULES AND THE PERMISSION TO USE VIDEO FORM, YOU WILL NOT BE PERMITTED TO ENTER THE CONTEST AND ANY ATTEMPTED ENTRY WILL BE VOID.  Video files must have one of the following file extensions:  .mov, .asf, .mpg, .mpeg, .avi, .asf, .wmv, or .rm.  File size limit is 100 MB. If Video exceeds 30 seconds, only the first 30 seconds of Video will be viewed and/or used. While you may wish to include an actual car that you own in your Video, you are not required to do so.  Video cannot include music.  Limit one entry per person.  All entries must be received by 11:59 pm (ET) on March 21, 2006.  Use of robotic, programmed, automated or other means to enter the Contest in a manner other than as provided for in these Official Rules is prohibited.  By entering the Contest online, participants acknowledge that they are aware of and agree with the Sponsor’s privacy policy located at: http://www.aetv.com/feedback/privacy.html.  Entries may not have been published or submitted to any other contest or competition.  All Entries will become the property of Sponsor; entrant agrees to assign the copyright in the Video to Sponsor.  Entries must not include third party copyrighted material, trademarks, names, likenesses or other proprietary material without the appropriate third party’s permission.  By way of example only, Video must not contain any names, trademarks, logos or designs which identify a particular make or model of car. By way of example also, if a person other than the entrant appears in your Video, you must have such person’s written permission.  Entry must be solely the original work of entrant, except that a third party may record entrant as the subject of entrant’s Video. The Video must be appropriate and suitable for publication and broadcasting, not containing any vulgar, lewd, defamatory, profane or violent material.  If Sponsor or Administrator determines, in its sole discretion, that an entry is not in compliance with these Official Rules, the entry will be automatically disqualified.

  3. WINNER SELECTION:  All eligible entries received will be evaluated by Administrator, an independent judging organization, with Administrator choosing the two (2) finalist entries (i.e., Videos) on or about March 22, 2006.  Administrator will use the following criteria in judging entries:  Persuasiveness, believability, creativity, originality and relevance to theme.  In the event of a tie, one or both of the two (2) finalist entries will be determined based on which entry receives the higher/highest score in persuasiveness.  The two (2) finalist entries will then be independently evaluated anew by Josh “Chop” Towbin, a professional car dealer (“Chop”). Chop will not consult or otherwise rely upon Administrator’s judging in evaluating the two (2) finalist entries.  Chop will use the same criteria (including the tie-breaker, if necessary) as stated above to choose the Grand Prize winner from the two (2) finalist entries.   The finalist not chosen as the Grand Prize winner will win the First Prize.  Any public voting of the entries on-line and/or on-air is for entertainment purposes only and will have no effect on determining the winners in this contest.  Grand Prize and First Prize winners will be notified by phone on or after March 24, 2006 and announced on-line and/or on-air during a forthcoming episode of “King of Cars”. 

  4. PRIZES: Grand Prize (1): A trip for winner and his/her guest for 4 days and 3 nights to Las Vegas and an opportunity to meet Chop (Approximate Retail Value $5,000.00). First Prize (1): A&E King of Cars related merchandise.  Approximate retail value of First Prize is $75.   Grand Prize trip consists of round-trip coach class air transportation, for winner and guest, from a major gateway airport near Grand Prize winner’s residence (Sponsor’s choice), ground transportation to and from the Las Vegas airport, standard hotel accommodations based on double occupancy (Sponsor’s choice of hotel), and a total of $1000 spending money.   Spending money will be awarded to Grand Prize winner only, as cash or traveler’s checks, at Sponsor's sole discretion.  Meeting Chop is subject to his professional commitments and availability.  Entrant understands and agrees that meeting Chop has no retail value and if Grand Prize winner is unable to meet Chop for any reason, the remaining elements of the Grand Prize shall represent Sponsor’s sole liability to winner. 

    Prizes are nontransferable. Grand Prize trip is also subject to availability, blackout dates and other restrictions. Grand Prize winner must provide Sponsor with at least 45 days’ advanced notice prior to intended date of departure.  Grand Prize travel must be completed no later than April 1, 2007.  If Winner is unable to accept prize for any reason, prize will be forfeited and the prize awarded to another entrant (as detailed in “Disqualification/Award of Prizes” in Paragraph 5 below). All expenses not specified in these Official Rules, including without limitation, meals, taxes, incidentals and other expenses, are the winner’s (and his/her guest’s) sole responsibility.  If Grand Prize winner lives within 150 miles of Las Vegas, ground transportation between winner’s residence and hotel shall be provided to winner and his/her guest, instead of air transportation.  Grand Prize winner will not receive any compensation if actual retail value of trip is less than projected approximate retail value. If Grand Prize winner does not have (1) guest accompany him/her on trip, winner understands and agrees that air transportation, ground transportation and hotel accommodations will only be awarded in amounts appropriate for one traveler (i.e., the winner him/herself); and, that no compensation shall be provided for any such unawarded prize components. Guest of Grand Prize winner must be 21 years of age or older.  Taxes are the sole responsibility of prize winner. Grand Prize Winner and guest must travel on same itinerary, as set by Sponsor in its sole discretion. Limit one prize per household. 

  5. GENERAL RULES:  Contest is governed by the laws of the State of New York, with venue and jurisdiction in New York County, NY and all claims must be resolved in the courts located in New York County, NY.  All federal, state and local laws and regulations apply. Sponsor and its agencies are not responsible for incomplete, lost, late, damaged, illegible or misdirected e-mail, for any technical problems, malfunctions of any telephone lines, computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Sponsor and its agencies are not responsible for any damage to any participant's computer system/software related to or resulting from participation or downloading any materials in this promotion. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. If for any reason the promotion is canceled, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes outside control of Sponsor which impair or affect the administration, security, fairness, integrity, or proper conduct of this promotion, Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and to cancel, modify, terminate or suspend the contest. In the event of termination, a notice will be posted on the promotional website and winners will be selected from among all unaffected eligible entries received prior to the time of termination or by such other means as sponsor determines in its sole discretion is fair, appropriate and is consistent with the spirit of the Official Rules. In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the authorized account holder of the e-mail address associated with the entry (authorized account holder being the natural person assigned an e-mail address by an Internet access provider, on-line service provider or other organization which is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address). Potential Grand Prize winner and First Prize winner must each sign and return an Affidavit of Eligibility/Release of Liability/Release of Publicity (where legal) within 1 day of date indicated on notification materials in order to claim prize and to permit his/her name to be announced as a winner on a forthcoming episode of “King of Cars;” failure to do so may result in disqualification. Disqualification/Award of Prizes: In the event of disqualification of Grand Prize winner, the First Prize winner will become the Grand Prize winner and will receive the Grand Prize instead of the First Prize and the entrant whose Video/entry was ranked #3 by the judges (Administrator and Chop) will become the First Prize winner.   In the event of disqualification of First Prize winner, the entrant whose Video/entry was ranked #3 will become the First Prize winner.  If both Grand and First Prize winner are disqualified, the entrant whose Video/entry was ranked #3 will become the Grand Prize winner and the entrant whose Video/entry was ranked #4 will become the First Prize winner. This process will continue until both prizes are awarded.  Guest of Grand Prize Winner must sign and return a release of liability/release of publicity (where legal) prior to issuance of travel documents. Grand Prize Winner will be issued an IRS 1099 Income Tax Form in the amount of the Actual Retail Value of the prize as it exceeds $600. Return of any prize/prize notification as undeliverable will result in disqualification.  All prizes will be awarded.  Sponsor reserves the right to substitute prize or prize component of equal or greater value in the event of unavailability of prize/prize component for any reason. Acceptance of prize constitutes permission to Sponsor and its agencies to use winner’s name, voice and/or likeness for purposes of advertising and trade without further compensation, unless prohibited by law. By participating in this promotion, entrants agree to be bound by the Official Rules and the decisions of the judges (i.e., Administrator and Chop, as appropriate), which are final and binding in all matters related to the contest.  By accepting prize, winners agree to hold A&E Television Networks, Civic Entertainment Group, LLC, Towbin Dodge, their affiliates, subsidiaries, prize suppliers, advertising and promotion agencies, their respective officers, employees, directors, and representatives harmless against any and all claims and liability arising out of use of prize. Winners assume all liability for any injury or damage caused, or claimed to be caused by participation in this promotion or use or redemption of any prize. Sponsor not responsible for typographical or other error in the printing of the offer, administration of the contest or in the announcement of the prize. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any contest materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control.
